AA says INEC failed to fully obey court order on Omoaje’s recognition

The Action Alliance (AA) has accused the Independent National Electoral Commission (INEC) of misleading the Federal High Court sitting in Osogbo, Osun State, regarding its compliance with a judgment directing it to recognize Hon. Adekunle Rufai Omoaje as the party’s national chairman.

At the resumed hearing on Thursday before Justice Funmilola Demi-Ajayi, counsel to the party, O.K. Etibo, argued that INEC had only partially complied with the court’s ruling. According to him, although the commission uploaded the names of the National Executive Committee (NEC) members elected alongside Omoaje at the party’s elective national convention held in October 2023 in Abeokuta, Ogun State, it failed to include Omoaje’s name as the substantive national chairman on its official portal.

Etibo faulted the representation of facts by INEC’s counsel, Gilbert, who told the court that the commission had fully complied with the judgment but refrained from listing Omoaje as chairman due to a pending case at the Supreme Court. The AA counsel maintained that INEC’s claim was misleading and clarified that his client had already written to the Supreme Court requesting a date for the hearing of the suit, though none had been fixed yet.

Justice Demi-Ajayi recalled that at the previous sitting, the court had directed the party to approach the Supreme Court to confirm the status of the matter allegedly filed by Omoaje. Both counsels, however, agreed that the case remains pending before the apex court.

After listening to both parties, Justice Demi-Ajayi adjourned the matter to December 9, 2025, for ruling.
